By accessing or using SurfingUp ("the Platform"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Platform. These terms constitute a legally binding agreement between you and SurfingUp. We may update these terms from time to time, and your continued use of the Platform after changes are posted constitutes your acceptance of the updated terms.

To use certain features of SurfingUp, you must create an account. When registering, you agree to: • Provide accurate, current, and complete information • Maintain and promptly update your account information • Keep your login credentials secure and confidential • Be responsible for all activity under your account • Notify us immediately of any unauthorized use of your account You must be at least 18 years old to create an account and use the Platform. By registering, you represent and warrant that you meet this age requirement.

As a member of the SurfingUp community, you agree to: • Treat all community members with respect and dignity • Provide honest and accurate information in your profile and listings • Honor confirmed bookings and commitments • Communicate promptly and transparently with other users • Follow all applicable local laws and regulations • Report any suspicious or inappropriate behavior You are solely responsible for your interactions with other users. SurfingUp is a platform that connects travelers and hosts but is not a party to any agreements between users.

You may not use SurfingUp to: • Violate any applicable laws or regulations • Post false, misleading, or deceptive content • Harass, threaten, or intimidate other users • Discriminate against users based on race, gender, religion, nationality, disability, or any other protected characteristic • Use the platform for any commercial purpose not authorized by SurfingUp • Attempt to hack, reverse-engineer, or compromise the Platform's security • Create multiple accounts or impersonate another person • Collect or harvest user data without authorization • Send spam or unsolicited communications • Upload malicious software or harmful content

SurfingUp uses a virtual coin system for certain transactions on the Platform: • Coins can be purchased through the Platform or earned through community participation • Coins have no real-world monetary value and cannot be exchanged for cash • Coin balances are non-transferable between accounts • SurfingUp reserves the right to modify coin pricing and earning mechanisms • Refunds for purchased coins are subject to our refund policy • Unused coins remain in your wallet as long as your account is active All transactions are final unless otherwise stated. Disputes regarding transactions should be raised through our support channels within 30 days.

**For Hosts:** • You are responsible for the accuracy of your listing information • You must maintain a safe and clean environment for travelers • You agree to honor confirmed bookings unless exceptional circumstances arise • You are responsible for compliance with local hosting laws and regulations **For Travelers:** • You agree to respect the host's property and house rules • You are responsible for any damage caused during your stay • You must provide accurate information when making booking requests • Cancellation policies apply as specified at the time of booking SurfingUp does not own, manage, or control any hosting properties and is not responsible for the condition or safety of any accommodation.

SurfingUp reserves the right to suspend or terminate your account at any time for: • Violation of these Terms of Use • Fraudulent or illegal activity • Behavior that harms the community or other users • Extended periods of inactivity • Any other reason at our sole discretion Upon termination, your right to use the Platform ceases immediately. Any remaining coin balance may be forfeited. You may also delete your account at any time through your account settings.

SurfingUp is provided on an "as is" and "as available" basis. To the fullest extent permitted by law: • We make no warranties regarding the reliability, availability, or accuracy of the Platform • We are not liable for any indirect, incidental, special, or consequential damages • Our total liability shall not exceed the amount you paid to us in the preceding 12 months • We are not responsible for the actions, content, or conduct of any users • We do not guarantee any specific outcomes from using the Platform You agree to indemnify and hold SurfingUp harmless from any claims, damages, or expenses arising from your use of the Platform or violation of these terms.
